Although it was "sameness" that inspired Sephora's lawsuit

Sephora won't need its day in court after all.

Sephora USA LLC (San Francisco) and Federated Department Stores Inc. (Cincinnati) have settled an infringement suit initiated by Sephora, without a judge or jury.

Evidently unflattered by imitation, the cosmetics retailers with the lacquer red and Zebra- colored motif, sued Federated and Macy's West Inc., contending Macy's Souson stores and in-store Souson departments had mimicked Sephora's trademark look. The case was slated for trial in September.

Sephora, which made its U.S. debut three years ago, now operates 53 stores here and more than 200 stores in Europe. Terms of the settlement were not disclosed.
