PETCO faces delisting by NASDAQ due to late filings

PETCO Animal Supplies Inc. (San Diego) has received notice from The Nasdaq Stock Market that it is subject to delisting as of May 31, 2005 due to its failure to file its annual report on Form 10-K for the fiscal year ended January 29, 2005.

On April 29, the pet supplies retailer had announced a delay in the filing of certain forms pending the completion of an internal review into errors involving the accrual of operating expenses. The delay has put the company in non-compliance with a NASDAQ marketplace rule requiring the timely filing of all reports and other documents.

PETCO said it plans to request a hearing before a NASDAQ panel to request continued listing on NASDAQ until it can file its form.
